1. Definitions
For the purposes of these Terms of Service ("Terms"), the following definitions shall apply:
- Producer: Means any person or entity who films, videotapes, photographs, or otherwise creates a visual depiction of actual sexually explicit conduct, and/or any person or entity who produces, assembles, manufactures, publishes, duplicates, reproduces, or reissues a photograph, video, or other matter intended for commercial distribution that contains a visual depiction of actual sexually explicit conduct.
- Content: Means all photos, videos, and other media uploaded to BentBox.
- Sexually Explicit Conduct: Means "actual sexually explicit conduct" as defined in 18 U.S.C. § 2257(g), which includes depictions of: (i) patently offensive representations or descriptions of ultimate sexual acts, normal or perverted, actual or simulated, including sexual intercourse, oral-genital contact, or masturbation; (ii) patently offensive representations or descriptions of lewd exhibition of the genitals or pubic area; or (iii) the lascivious display of the human body.
2. User Responsibilities
By using BentBox, you agree to the following:
- 2257 Compliance: Any user who uploads Content to BentBox that contains a visual depiction of actual sexually explicit conduct, as defined herein, is considered a Producer and is solely responsible for complying with all requirements of 18 U.S.C. § 2257, including, but not limited to, the creation and maintenance of individually identifiable records pertaining to every performer portrayed in such visual depiction.
- Record Keeping: Producers are responsible for ascertaining, by examination of an identification document, the performer's name and date of birth, and for requiring the performer to provide such other indicia of their identity as may be prescribed by law. Producers must also ascertain any name, other than the performer's present and correct name, ever used by the performer, including maiden name, alias, nickname, stage, or professional name.
- Content Labeling: Producers are responsible for ensuring that all copies of any matter containing depictions of actual sexually explicit conduct have affixed thereto a statement describing where the records required by this section are maintained, in such manner and in such form as required by applicable law.
- Accuracy of Information: Users represent and warrant that all information provided to BentBox, including information provided in connection with 2257 compliance, is true, accurate, and complete. Users shall be solely liable for any false, misleading, or incomplete information.
3. BentBox's Role and Limitations
BentBox provides a platform for users to upload and sell Content. BentBox's role is limited to [describe the platform's functions, e.g., hosting, transaction processing, display of Content]. BentBox does not produce, create, or control the Content uploaded by users.
- BentBox is not responsible for ensuring the compliance of users with 18 U.S.C. § 2257. Users are solely responsible for their own compliance with all applicable laws and regulations.
- BentBox reserves the right to remove or refuse to display any Content that it believes, in its sole discretion, may violate 18 U.S.C. § 2257 or these Terms of Service.
4. Indemnification
Users agree to indemnify, defend, and hold harmless BentBox, its officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to any user's breach of these Terms of Service, including, but not limited to, any failure to comply with 18 U.S.C. § 2257.
5. Account Termination
BentBox reserves the right to terminate the account of any user who violates these Terms of Service, including those who fail to comply with 18 U.S.C. § 2257, and may also report such violations to law enforcement.
